The plaintiffs, Cuyahoga Valley Homeowners and Residents Association, et al., brought this class action seeking injuctive and declaratory relief. They sought inter alia a judicial interpretation of the extent of the defendants authority under the Cuyahoga Valley National Recreation Act (CVNRA) 16 U.S.C. § 460 ff. ef. seq. Of particular concern to the plaintiffs was the defendants ability to acquire single family residential property located within the boundaries of the CVNRA through eminent domain proceedings. Both parties filed motions for summary judgment. On April 13, 1982, the Court issued a Memorandum of Opinion granting the defendants motion for summary judgment.
